Applicability
Minimum Wages Act 1948 applies to whole of India except jammu and Kashmir.
The purpose of Act is to provide for fixing of minimum rates of wages in certain employments.
In this act wages means all remuneration (whether way of salary, allowance or otherwise) expressed in terms of money or capacity but does not include bonus which does not form part of remuneration payable, value of house accommodation, contribution to PF, traveling allowance or gratuity.
Fixation of minimum wages
Minimum wages will be fixed by Appropriate Government after following prescribed procedure. The rate fixed can be revised periodically. [Section 3(1)].The rate can be fixed on time work basis piece work basis a ‘guaranteed rate’ when rate is fixed on piece work basis and overtime rate. Minimum wages will be fixed after appointing a committee. Their proposals will be published by way of notification. After hearing representations, rate of minimum wages will be notified.
